Terms of use for the Oenolosite free trial
Version 1.4 — last updated: 29 October 2026
1. Purpose and publisher
These terms govern the free use of the Oenolosite preview service (the “Trial”), offered by Clément Boschet, sole trader (entrepreneur individuel, EI), trading as Demat Future, SIREN 902 052 984, La Boissière Cado, 56380 Monteneuf, France (“Demat Future” or “we”).
The Trial lets a winery see what its website could look like, by choosing a theme and supplying a little information.
2. Who can create a preview
The Trial is reserved for professionals: wineries, wine estates and wine businesses (the “Winery”). The person who creates the preview declares that they act solely in the course of their professional activity; they must be of legal age and authorised to act for the Winery named in the form.
3. Acceptance
To create a preview, you tick a box (unticked by default) by which you accept these terms and confirm that you are authorised to act for the Winery; the terms and the privacy policy are available next to this box. We record the version accepted and the date and time of acceptance.
4. What the Trial includes
- A short form: the Winery’s name, desired address, contact details, theme, logo or image, a short presentation and, optionally, a few wines.
- A preview that can be viewed at an address of the form
oenolosite.com/domaines/<identifier>. - The ability to come back and edit your information using a link sent to your email address.
The preview:
- is not your production website and does not use your domain name;
- is not indexed by search engines, but remains accessible to anyone who knows its address: it is therefore not private;
- may contain examples (for example fictitious wines) clearly marked as such;
- does not allow online sales, payment or bookings.
The Trial is free and without commitment. No means of payment is requested.
5. Preview identifier
The identifier chosen (the <identifier> part of the address) is reserved for the duration of the Trial. It gives you no right to that name. We may refuse or withdraw an identifier that repeats the name of another winery, a trademark or an appellation you are not entitled to use, or a term reserved for the operation of the service. The final address of the production website is agreed with you when it is launched.
6. Your content and the rules to follow
You remain the owner of the texts, logos, images and information about your wines that you supply (the “Content”).
What the preview may contain. The presentation of the Winery (story, terroir, know-how, places to visit, contact details) and, for the wines, objective information: name, appellation and origin, vintage, grape varieties and composition, alcohol content, method of production, characteristics of colour, aroma and taste, awards received, food pairings and ways of serving.
What it may not contain. Any content that is contrary to the law, in particular to the rules on advertising alcoholic drinks of the country the preview is aimed at (in France, articles L. 3323-2 et seq. of the French Public Health Code, the Évin law; in Portugal, Article 17 of the Código da Publicidade): encouraging excessive consumption, associating alcohol with social, sporting or sexual success, content aimed at minors; as well as any content that is misleading, defamatory, infringing or contrary to public order.
Permissions. You warrant that you hold the rights to the Content (copyright, trademarks) and the agreement of people who can be recognised in photos or are named. The health or age notices that we display on previews, depending on the country, are not enough to make the Content compliant: its compliance remains your responsibility.
Licence. You authorise us, free of charge and for the duration of the Trial, to host, reproduce, adapt (formatting, resizing of images) and display the Content in the preview, and to use it to prepare our commercial proposal. We do not use it for any other purpose, in particular advertising, without your written agreement.
7. Reports, moderation and removal
Anyone may report Content to us using the form at oenolosite.com/en/report or the “Report this page” link on every preview. We examine reports diligently and objectively, and may also review the Content on our own initiative, in particular with regard to the rules cited in article 6, and suggest corrections to you.
We may remove Content, hide the preview or suspend it when it is manifestly unlawful or contrary to article 6, when it was created in the name of a Winery without its authorisation, or when it is used for purposes other than discovering the service (spam, phishing, promotion of a third party).
A report never leads to automatic removal on its own. When a substantiated report raises a serious doubt about the lawfulness of Content, we may temporarily hide the preview: we then review the Content within 5 working days, with your comments if you send us any, and lift the hiding if the doubt is not confirmed.
In each case, we send you a statement of reasons by email: the measure taken, its territorial scope and duration, the facts and, where applicable, the report behind the decision, the indication that the decision was taken by a person without automated means, the rule of law or the clause of these terms concerned, and your means of redress. You may challenge the decision by replying to that email or writing to contact@getoenolosite.com; we then review the decision. You keep the right to go to court.
8. Duration, deletion and legal retention
- The Trial, and the contract formed by these terms, end when the preview is deleted (automatically or on request) or when a publishing contract replaces it.
- The preview and its Content are deleted automatically 10 days after your last activity. The last activity is the last saved change or the last sign-in through the link received by email. We send you a reminder email before deletion.
- If the link received by email at sign-up is never opened, the preview is deleted automatically 7 days after sign-up. We send you the link again once, the day after sign-up.
- You may ask for deletion at any time by writing to contact@getoenolosite.com.
- Deleting the preview does not erase the data that the law requires us to keep as a host (the contact’s identity, account identifier, connection identifier and protocols linked to operations on the Content), nor the security logs, which are kept separately for the periods given in the privacy policy (sections 2 b and 2 c).
9. Commercial follow-up
After the preview is created, we may contact you to offer to put your website online. You are free not to follow up, and you may ask us to stop contacting you.
Putting a production website online is covered by a separate contract, which sets out the price, term, invoicing and termination conditions. When you choose to launch your website, the information entered during the Trial is carried over, so that you do not have to enter it again.
10. Availability and liability
The Trial is provided free of charge, as is. We make our best efforts to keep it accessible, without guaranteeing continuous availability or the absence of errors. We may change or end the Trial; existing previews are then deleted after notice by email at least 15 days in advance.
Each party is liable for damage caused by its own fault. As this is a free service, our contractual liability is limited to direct and foreseeable damage; this limit does not apply in the event of wilful misconduct or gross negligence, by us or by the people we use, to harm to life, physical or moral integrity or health, or to obligations that the law prohibits from being limited.
Indemnity. If a third party claims compensation from us because of Content that you supplied and that is unlawful or used without authorisation, you indemnify us for the consequences of that claim (compensation payable by us and reasonable defence costs). We tell you of the claim as soon as possible, allow you to conduct the defence at your own expense and do not settle without your agreement. This indemnity does not cover damage caused by our own fault.
11. Personal data
The data collected during the Trial is processed in accordance with our privacy policy. The personal data that you place in your Content is processed on your behalf under the annex below.
12. Changes to the terms
We may change these terms for the future. Any important change (use of the Content, duration of the Trial, price, data processing) is notified to you by email at least 15 days before it takes effect and applies only after your new acceptance, requested at your next sign-in; if you do not accept, you may delete your preview. Other changes apply from the date given in the notification. Until then, the version that applies remains the one you accepted.
13. Governing law and disputes
These terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the courts with jurisdiction are those designated by the ordinary rules of law.

Annex — Personal data processed on your behalf (article 28 GDPR)
Where your Content includes personal data (for example the name or photo of a member of your team), the Winery is the controller and Demat Future acts as processor, on the following terms:
- Subject matter and duration: host and display this data in the preview for the duration of the Trial (article 8).
- Nature and purpose: storage, formatting and public display in the preview; no other use.
- Data and data subjects: names, roles, photos and information that you choose to publish about people connected with the Winery.
- Instructions: we process this data only on your documented instructions, given by using the Trial and in writing, unless a legal obligation requires otherwise, in which case we would tell you.
- Confidentiality: only the people who need it have access, and they are bound by confidentiality.
- Security: encryption of communications, restricted access, backups and hosting in the European Union (article 32 GDPR).
- Sub-processors: you authorise us to use Scaleway SAS (hosting of the data and backups, European Union), the only provider that processes this data on your behalf; our other providers (email sending, anti-robot check, mailbox) have no access to it. We tell you at least 15 days in advance of any addition or replacement, which you may refuse by deleting your preview; each sub-processor is bound by the same obligations as those in this annex.
- Assistance: we help you respond to requests from data subjects and, where relevant, with security, data breaches and impact assessments.
- Data breach: we inform you without undue delay of any data breach affecting this data.
- End of processing: at the end of the Trial, at your choice, we return this data to you (export of the Content on request before deletion) or delete it, without keeping a copy; if you make no choice, it is deleted with the preview (article 8). Only the data kept under a legal obligation (the contact’s identity, account identifier, connection identifier and protocols linked to operations on the Content) remains kept, separately and to answer the authorities, for the periods in the privacy policy.
- Control and audit: we make available to you the information needed to demonstrate compliance with these obligations. You may carry out, or have carried out, by an auditor bound by confidentiality and with 30 days’ notice, an audit of this processing, at your own expense, no more than once a year unless there is a data breach. We cooperate with any inspection by a supervisory authority.
These terms were written in French and translated into Portuguese and English; if the versions differ, the French version prevails.
